We analyze each bankruptcy referral under the Bankruptcy Codes, Rules and case law. We evaluate the bankruptcy filing and schedules, our client’s accounting, and whether the filing of a proof of claim is required.

As with foreclosure, our bankruptcy practice focuses on improved recovery. We utilize Chapter 13 to collect arrearages and maintain post-petition monthly payments while providing adequate protection for our client. We will object to a Plan that does not adequately provide for our client, and we advocate against abusive repeat filers.
